The US Department of War is reportedly examining whether Senator Mark Kelly could be recalled to active military duty for possible court-martial. The review comes after a video in which Kelly and several other Democratic lawmakers urged members of the US military to refuse any unlawful orders.

The Department of war also issued an official statement saying it has received serious allegations of misconduct against Captain Mark Kelly, USN (Ret.). The department said it has started a formal review under the Uniform Code of Military Justice (UCMJ) to decide what should happen next. This could include recalling him to active duty for a court-martial or taking other administrative action.

In the statement, the department said, “The Department of War has received serious allegations of misconduct against Captain Mark Kelly, USN (Ret.). In accordance with the Uniform Code of Military Justice, 10 U.S.C. § 688, and other applicable regulations, a thorough review of these allegations has been initiated to determine further actions, which may include recall to active duty for court-martial proceedings or administrative measures. This matter will be handled in compliance with military law, ensuring due process and impartiality. Further official comments will be limited, to preserve the integrity of the proceedings."

Video From Democratic Lawmakers Sparks Backlash

The video that triggered the controversy featured Senators Elissa Slotkin and Mark Kelly, along with Representatives Jason Crow, Maggie Goodlander, Chris Deluzio and Chrissy Houlahan. In the clip, they told members of the US military and the intelligence community to uphold the Constitution and refuse any illegal commands. They warned that the Trump administration was placing these institutions in conflict with the American public and challenging fundamental democratic principles.

Donald Trump’s Reaction

On Thursday, US President Donald Trump sharply criticised the lawmakers, and accused them of encouraging troops to defy his administration, calling their actions “traitorous."

He warned that such behaviour could carry the most severe consequences.

“SEDITIOUS BEHAVIOR, punishable by DEATH!" Trump wrote on Truth Social.

In another post, he added, “This is really bad, and Dangerous to our Country… Their words cannot be allowed to stand. SEDITIOUS BEHAVIOR FROM TRAITORS!!! LOCK THEM UP???"
