A full day has passed since the Luthra brothers were detained by Thai immigration authorities, yet there is no sign of their deportation. The reason for the delay, according to top Indian government sources, is the legal process required under Thai laws. The brothers had travelled to Phuket shortly after the December 6 fire at their Goa nightclub left 25 people dead.

Gaurav, 44, and Saurabh, 40, left the country at 1.17 am on December 7, barely an hour after learning about the fire at their club.

Officials familiar with the matter indicate it could take a minimum of two more days before the Luthras reach India.

Reasons for the delay in deportation

Sources explained that the revocation of the Luthra brothers’ passports means that an emergency document must be created for them to leave Thailand. Although the Indian embassy can prepare this emergency travel document urgently, other legal formalities are involved.

Thailand is moving to cancel the Luthra brothers’ visas on the grounds of misleading immigration officers about their true intentions of the visit. Tourist visas are granted on arrival for tourism purposes only, and the Blue notice establishes that they were fugitives from Indian law, sources said.

“Visa cancellation could entail a Thai court order declaring them as individuals who are in Thailand illegally. Only this would pave the way for deportation," an official told CNN-News18.

Sources said it is likely that the Luthra brothers will be taken to a detention centre in Bangkok on Friday to complete other legal procedures. “This could take 2 days or more, and we also have to factor in the weekend that falls within that timeline," an official added.

The Luthra brothers were picked up from Hotel Indigo in Patong Beach early on Thursday morning after a Blue notice from Interpol. Their anticipatory bail plea was rejected by a Delhi court, paving the way for legal action by Indian authorities.
