Two Democratic lawmakers in California introduced legislation on Monday that aims to hold oil and gas companies liable for damages caused by climate change-related disasters. The bill accuses the oil industry of deliberately misleading the public about the harmful effects of fossil fuels, which have contributed to severe storms, wildfires, and billions of dollars in damage across the state.
Escalating Crisis in the Insurance Market
Supporters of the bill argue that intensified climate disasters have pushed California’s insurance market into turmoil. With rising rates, reduced coverage, and insurers pulling out from wildfire-prone areas, the state’s homeowners face increasing challenges in securing affordable insurance.
Utility Companies Set a Precedent for Accountability
Under current state law, utility companies can be held liable if their equipment sparks a wildfire. Advocates of the legislation, such as Robert Herrell, executive director of the Consumer Federation of California, believe the same principle should apply to oil and gas companies for their significant role in exacerbating climate-driven disasters.
Relief for Disaster Victims and Insurance Providers
The proposed bill aims to ease the financial burden on victims of climate-related disasters and insurance providers. It would grant victims the right to sue oil companies to recover losses. Additionally, California's Fair Access to Insurance Requirements (FAIR) Plan—established to assist homeowners unable to find insurance—would also be empowered to pursue legal action against the oil industry to avoid insolvency.
