A US prosecutor from Georgia on Wednesday officially dropped the historic racketeering case against President Donald Trump and his allies for allegedly attempting to overturn the 2020 presidential election, bringing an end to a legal effort that was once seen as a grave threat to Trump’s political career.
The move to drop the case meant that Trump will face no legal action for his alleged attempts to overturn the results of the 2020 election, where he lost to former President Joe Biden, CNN reported. Other federal cases against Trump from US special counsel Jack Smith related to the January 6 riots in the US Capitol and mishandling classified documents were previously dropped.
In a 23-page filing, Pete Skandalakis urged the judge to end the case, arguing it falls under federal, not state, jurisdiction. “Given the complexity of the legal issues at hand — ranging from constitutional questions and the Supremacy Clause to immunity, jurisdiction, venue, speedy-trial concerns, and access to federal records — and even assuming each of these issues were resolved in the State’s favor, bringing this case before a jury in 2029, 2030, or even 2031 would be nothing short of a remarkable feat," he said.
“In my professional judgment, the citizens of Georgia are not served by pursuing this case in full for another five to ten years," he added. Skandalakis, the executive director of the Prosecuting Attorneys’ Council of Georgia, took over the case himself earlier this month after he said he was “unable" to find someone else to accept the job.
This marks a significant victory for Trump, who had long denied accusations of trying to overturn the results of the 2020 elections and complained that the charges against him were politically motivated. The move meant that the last of several criminal prosecutions targeting Trump before he returned to office in January were dropped.
Steve Sadow, Trump’s lead attorney in Georgia, applauded the case’s dismissal. “The political persecution of President Trump by disqualified DA Fani Willis is finally over. This case should never have been brought. A fair and impartial prosecutor has put an end to this lawfare," he said.
Racketeering Charges Against Trump
The historic state racketeering charges were filed against Trump and 18 others on August 14, 2023, by Fulton County’s District Attorney Fani Willis, an elected Democrat, who launched a probe into Trump’s alleged interference in the Georgia election.
The investigation began after a phone call from January 2021 was released to the public, in which Trump allegedly pressured Secretary of State Brad Raffensperger, a fellow Republican, to “find" the votes necessary for him to win the state in the Presidential election. Willis was eventually removed from the case after a lengthy legal fight over her authority ollowing accusations of impropriety regarding her relationship with a fellow prosecutor.
The case attracted further attention when Trump surrendered in the Atlanta jail for a little over 20 minutes in August 2023, where he was forced to provide his mug shot for the first time. Expectations were high that the case would go to trial as it was a state case handled by a local Georgia prosecutor.
