Hours after Aam Aadmi Party (AAP) MLA Naresh Balyan was granted bail by a Delhi court in an extortion case on Wednesday, he was arrested again by the Delhi Police in a separate FIR. He was taken into custody on charges under the stringent Maharashtra Control of Organised Crime Act (MCOCA).
This comes after Additional Chief Metropolitan Magistrate Paras Dalal had granted bail to Balyan on a personal bond of Rs 50,000, with one surety of the same amount.
The judge rejected the police’s plea for 14-day judicial custody and dismissed their request for his arrest in a fresh case filed under the stringent Maharashtra Control of Organised Crime Act (MCOCA), deeming it not maintainable.
Earlier today, Delhi Police moved the court, seeking to arrest Balyan in a new case involving alleged organised crime. The application was filed after Balyan’s three-day custody in the extortion case expired.
The police requested that Additional Chief Metropolitan Magistrate Paras Dalal send Balyan to judicial custody while also seeking his arrest in the new case under MCOCA.
Charges Against Balyan
Balyan was arrested by the Delhi Police’s Crime Branch last week after an investigation revealed an audio clip of a conversation between the AAP leader and a gangster, reportedly based in London, known as Nandu.
According to the Delhi Police, the conversation in the audio clip involved discussions about extorting ransom money from a businessman. The Uttam Nagar MLA was summoned to the Crime Branch office in R.K. Puram for questioning and was subsequently arrested on November 30.
Additionally, the Bharatiya Janata Party (BJP) had accused the AAP leader of allegedly colluding with gangster to extort money from business owners.
The saffron camp charged that the AAP leader was involved in threatening people and extorting money from them.
Meanwhile, the Aam Aadmi Party had defended Naresh Balyan, claiming that his arrest was illegal. The MLA had refuted the BJP’s allegations and said he would lodge police cases against those who “spread lies" about him.
Party chief Arvind Kejriwal had lashed out at the BJP over the arrest and claimed that Balyan was a “victim of gangster Kapil Sangwan".
